In addition, graphics, logos, page headers, button icons, scripts, and service names included in or made available through any Carib Island Trading Service are trademarks or trade dress of Carib Island Trading in the U.S. and other countries. Carib Island Trading’s trademarks and trade dress may not be used in connection with any product or service that is not Carib Island Trading’s, in
any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Carib Island Trading. All other trademarks not owned by Carib Island Trading that appear in any Carib Island Trading Service are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Carib Island Trading.

LICENSE AND ACCESS

Subject to your compliance with these Terms of Use and any Service Terms, and your payment of any applicable fees, Carib Island Trading or its content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the Carib Island Trading Services. This license does not include any resale or commercial use of any Carib Island Trading Service, or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of any Carib Island Trading Service or its contents; any downloading, copying, or other use of account information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools. All rights not expressly granted to you in these Terms of Use or any Service Terms are reserved and retained by Carib Island Trading or its licensors, suppliers, publishers, rightsholders, or other content providers. No Carib Island Trading Service, nor any part of any Carib Island Trading Service, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of Carib Island Trading. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Carib Island Trading without express written consent. You may not use any meta tags or any other “hidden text” utilizing Carib Island Trading’s name or trademarks without the express written consent of Carib Island Trading. You may not misuse the Carib Island Trading Services. You may use the Carib Island Trading Services only as permitted by law. The licenses granted by Carib Island Trading terminate if you do not comply with these Terms of Use or any Service Terms.

YOUR ACCOUNT
You may need your own Carib Island Trading account to use certain Carib Island Trading Services, and you may be required to be logged in to the account and have a valid payment method associated with it. If there is a problem charging your selected payment method, we may charge any other valid payment method associated with your account, including but not limited to cover past due fees and any costs that may arise from disputes. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password. Carib Island Trading does sell products for children, but it sells them to adults, who can purchase with a credit card or other permitted payment method. All adult listings on Carib Island Trading are intended for adults only. You must be at least 21 years of age to purchase any adult items or use any site functionality related to adult products. Prior to being allowed to sell using the Carib Island Trading Services, Vendors must provide proof that they are a registered U.S. business entity and provide their Federal Employer Identification Number. This is achieved by completing our “Vendor Complete Account Form”. Vendors are also required to only sell/list products that are physically located within the United States. Violation of selling/listing products that are located outside of the United States, and for shipments that originate from outside the United States, are subject to permanent vendor account suspension. Prior to being allowed to complete
purchases using the Carib Island Trading Services, Buyers must provide proof that they are a sales tax-exempt entity by completing our “Buyer Complete Account Form”. Both Vendor and Buyer memberships/subscriptions can be cancelled at any time at no extra cost. All Vendor and Buyer membership payments are final and non-refundable. Carib Island Trading Inc. reserves the right to refuse service, terminate accounts, terminate your rights to use Carib Island Trading Services, remove or edit content, or cancel orders in its sole discretion and reserve the right to withhold funds from accounts that violate these terms.

SALES TAX EXEMPTION
For Vendors: By using the Carib Island Trading Services and Website you agree that all products you are offering for sale on Carib Island Trading Services are strictly sold to sales-tax exempt entities. Therefore making all sales not subject to sales tax.

For Buyers: By using the Carib Island Trading Services and Website you agree that all purchases you complete on the Carib Island Trading
Services are not for personal consumption and that you must provide sales-tax exemption documentation prior to making any purchases. Therefore making the sales not subject to sales tax. Buyers will be requested to provide their Tax ID information via our Buyer Sales Tax Exemption Verification Form within 60 days of creating an account.

Any violations of these terms may result in potential tax liabilities within your State. Carib Island Trading Inc. takes no responsibility and assumes no liability for Vendors or Buyers that are not
legally allowed tax exemptions for purchases or sales.

REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT
You may post reviews, comments, photos, and other content; submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights (including publicity rights), or otherwise injurious to third parties or objectionable, and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam” or unsolicited commercial electronic messages. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. Carib Island Trading reserves the right (but not the obligation) to remove or edit such content but does not regularly review posted content.

If you do post content or submit material, and unless we indicate otherwise, you grant Carib Island Trading a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works
from, distribute, and display such content throughout the world in any media. You grant Carib Island Trading and sublicensees the right to use the name that you submit in connection with such content if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Carib Island Trading for all claims resulting from
content you supply. Carib Island Trading has the right but not the obligation to monitor and edit or remove any activity or content. Carib Island Trading takes no responsibility and assumes no liability for any content posted by you or any third party.

RISK OF LOSS
All purchases of physical items from Carib Island Trading are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon delivery to the carrier.

PAYMENTS
By using the Carib Island Trading Services you understand and agree to our Payment Terms.

SHIPPING
We strive to deliver your purchases promptly. Shipping times and costs are determined by the shipping method selected and your location. Carib Island Trading is not responsible for delays caused by carriers, customs, or other factors outside of our control. All shipping and handling fees are non-refundable. If you receive a damaged or incorrect item, please contact our customer service team immediately to arrange for a return or exchange.

RETURN AND REFUND POLICY
Please review our Return and Refund Policy, which outlines the process for returning items and obtaining refunds. Returns are subject to specific terms and conditions, including timeframes for returning items and any applicable restocking fees. All refunds are processed in accordance with the Payment Terms outlined in these Terms of Use.

INDEMNIFICATION

Carib Island Trading reserves the right to modify or terminate the Carib Island Trading Services, or any part thereof, at any time without notice. We may also modify these Terms of Use at any time. Your continued use of Carib Island Trading Services following any changes constitutes your acceptance of the new Terms of Use. If you do not agree to the new terms, you must stop using the Services.

Account Responsibility

To access certain features of the Carib Island Trading Services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
